TaxesProposed statute
The question: Which household tax credits are protected?
The measure protects the Family Affordability and Earned Income tax credits from its revenue exemption.
The proposed text protects the Family Affordability Tax Credit and the Earned Income Tax Credit from reductions caused by exempting the full conservation revenue amount. Starting with fiscal years on or after July 1, 2028, it reduces the exempt amount if necessary to preserve those credits.

2026 Blue Book: Proposition 137How to read this
Section 24-77-110(4)(d) names the two credits and requires the applicable forecasting agency to calculate the maximum amount that can be exempted without causing the specified credit reductions. That safeguard can mean less money for the conservation programs.
What to keep in mind
This does not protect every tax credit or guarantee every household a credit. It also does not preserve ordinary TABOR refund amounts. It is a specific safeguard with a stated start date and a forecast-based calculation.
